12 plead guilty in circuit court; several sentenced

WILLIAMSON – A total of 12 defendants appeared before Mingo County Circuit Judge Michael Thornsbury on Wednesday, with all of them entering guilty pleas. Several of those present in the courtroom were also rendered their sentences for the crimes they allegedly committed.

David Lee Bumgarner pleaded guilty to burglary as charged in Indictment S12-F73, and attempt to commit grand larceny, as charged in Information S12-F107. Bumgarner waived his right to a presentence investigation and was sentenced to confinement in a state correctional facility for an indefinite term of not less than 2 years nor more 18 years.

Bumgarner was represented by Attorney Diana Carter Wiedel. Mingo County Sheriff’s Department (MCSD) Sgt. J. Smith was the investigating officer.

Thomas Ray Cline pleaded guilty to entry of building other than a dwelling as charged in Indictment S12-F75. Cline waived the right to a presentence investigation and was sentenced to confinement in a state correctional facility for an indefinite term of not less than 1 year nor more than 10 years.

Cline was represented by Attorney Jonathan “Duke” Jewell. West Virginia State Police (WVSP) Trooper J. D. Matheny was the investigating officer.

Cline also pleaded guilty to grand larceny as charged in Indictment S12-F76. Cline again waived the right to a presentence investigation and was sentenced to confinement in a state correctional facility for an indefinite term of not less than 1 year nor more than 10 years. The Indictment S12-F76 sentence was directed to run consecutively with the Indictment S12-F75 sentence. WVSP Senior Trooper C. A. Douglas was the investigating officer in this case.

Andrew Jackson Eastwood pleaded guilty to attempt to transferring stolen goods,a lesser included offense of the original charge of transferring stolen goods, as charged in Indictment S12-F78. Eastwood waived the right to a presentence investigation and was sentenced to confinement in a state correctional facility for an indefinite term of not less than 1 year nor more 3 years.

Eastwood was represented by Attorney Jonathan “Duke” Jewell. Norfolk Southern (NS) Corporation Special Agent M. McCloud was the investigating officer in this case.

Trista Rene Estep pleaded guilty to attempt to delivery a Schedule II controlled substance (Oxycodone) and conspiracy to delivery a Schedule II controlled substance (Oxycodone), as charged in Indictment S12-F79. Estep is exposed to a combined sentence of confinement in a state correctional facility for an indefinite term of not less than 2 years nor more 8 years.

Estep was represented by Attorney Stacey Kohari. Williamson Police (WPD) Chief C. D. Rockel and MCSD Corporal N. Mines were the investigating officers with assistance from Special Investigator E. Crum. Estep will be sentenced on December 3 at 9:00 a.m.

Jerry Lee Fields pleaded guilty to escape from custody as charged in Indictment S12-F81. Fields waived the right to a presentence investigation and was sentenced to confinement in a state correctional facility for a definite term of 5 years.

Fields was represented by Attorney Jonathan “Duke” Jewell. WPD Patrolman J. F. Taylor was the investigating officer and testified for the state.

Shawn Anthony Goff pleaded guilty to grand larceny as charged in Indictment S12-F83. Goff is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than 1 year nor more 10 years.

Goff was represented by Attorney Marsha Webb Rumora. MCSD Sergeant J. Smith was the investigating officer. Goff will be sentenced on December 3 at 9:00 a.m.

Diana Meade pleaded guilty to child neglect creating substantial risk of injury as charged in Indictment S12-F87. Meade is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than 1 year nor more 5 years.

Meade was represented by Attorney Kathryn Cisco Sturgell. WVSP Trooper J. D. Matheny was the investigating officer. Meade will be sentenced on December 3 at 9:00 a.m.

Mary Sammons pleaded guilty to conspiracy to Receive stolen goods as charged in Indictment S12-F93. Sammons is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than 1 year nor more 5 years.

Sammons was represented by Attorney Joshua S. Ferrell. MCSD Sergeant J. Smith was the investigating officer. Sammons will be sentenced on December 3 at 9:00 a.m.

William Oscar Stanley pleaded guilty to attempt to commit burglary as charged in Indictment S12-F97. Stanley waived the right to a presentence investigation and was sentenced to confinement in a state correctional facility for an indefinite term of not less than 1 year nor more 3 years.

Stanley was represented by Attorney Jonathan “Duke” Jewell. WPD Chief C. D. Rockel was the investigating officer.

Gary Lewis Vance pleaded guilty to delivery of Schedule II controlled substance (Oxycodone) and attempt to delivery a Schedule II controlled substance (Oxycodone), as charged in Indictment S12-F99. Vance is exposed to a combined sentence of confinement in a state correctional facility for an indefinite term of not less than 2 years nor more 18 years.

Vance was represented by Attorney Susan J. Van Zant. WPD Chief C. D. Rockel and MCSD Corporal N. Mines were the investigating officers with assistance from Special Investigator E. Crum. Vance will be sentenced on December 3 at 9:00 a.m.

Sarah E. Workman pleaded guilty to child neglect creating substantial risk of injury as charged in Information S12-F104. Workman is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than 1 year nor more 5 years.

Workman was represented by Attorney Kathryn Cisco Sturgell. WVSP Trooper J. D. Matheny was the investigating officer. Workman will be sentenced on December 3 at 9:00 a.m.

The act of entering guilty pleas by Vance and Estep is believed to be a record for the shortest time between arrest and conviction in a felony case in Mingo County history.

The Mingo County Prosecuting Attorney’s Office has now achieved 73 felony case convictions in 2012.
