Bill filed in Ky. Senate to protect tragedy victims from predators
FRANKFORT – Senator Ray S. Jones II, D-Pikeville, filed legislation Tuesday that he says will help to shield victims of accidents and disasters from predators.
Senate Bill 183 seeks to protect these victims from unwanted predatory solicitations in the 30 days following the tragedy.
Jones file the bill before taking a medical leave from the Senate for a scheudled surgical procedure.
“After a tragedy, the victim is in a vulnerable state, allowing them to be an easy target for greedy, so-called professionals, who prey on victims when they are defenseless or not thinking as clearly as they should,” said Senator Jones. “This legislation would protect the victim by giving them time to recover before they are beseeched by unsavory predators.
“There have been instances when policemen, while working in an official capacity, have been caught referring these victims to doctors and lawyers,” added Senator Jones. “There have also been cases where doctors and lawyers have made solicitations to others to put themselves in a position just to get a case. This is not right. It is unethical to prey on these victims while they are suffering from shock and confusion.”
The bill prohibits solicitations from any person who performs professional or occupational services pursuant to a license, permit, or other authority issued or granted by the Commonwealth, including lawyer and health care providers.
Solicitors cannot evade the 30-day quiet period by having other people solicit the victim on their behalf.
The bill does not prohibit advertising directed at the public, a solicitation made by virtue of a prior business relationship, or a referral made by a friend or relative.
“This legislation is not unprecedented, but builds upon Kentucky’s existing 30-day no solicitation statute applicable to attorneys,” said Senator Jones.
Violation of the bill’s provisions is a Class A misdemeanor, and may also subject the violator to professional discipline within their profession or occupation.
