Jury finds man not guilty of robbery charge

A 47-year-old local man was found not guilty of second degree robbery at the conclusion of his trial Wednesday in Mingo County Circuit Court.

Cecil Ray Diamond, who was represented by Public Defender David Foley, was acquitted of Count I of his January 2010 indictment.

He was accused of feloniously taking $1,400 in United States currency owned by Lacy Muncy and in the lawful custody and control of Robert Joshua Stacy. The indictment also charged Diamond with placing Stacy in fear of bodily injury by allegedly threatening him with a chemical substance.

After deliberating on the evidence and testimony produced in the trial, the jury returned a verdict finding Diamond not guilty as charged. The second degree robbery count and Count II charging the defendant with conspiracy will be dismissed.

Chief Judge Michael Thornsbury presided at the day-long trial. Assistant Mingo County Prosecutor Glen Rutledge represented the state in the trial.
