WILLIAMSON – Twenty-four defendants appeared before Chief Judge Michael Thornsbury in Mingo County Circuit Court Friday during arraignments for persons just indicted by the January Grand Jury.
Five of the 30 defendants indicted Wednesday failed to appear for arraignment and capiases for their arrest were issued. One indictment remains sealed pending the arrest of the person charged.
Mingo County Proisecuting Attorney C. Michael Sparks represented the state in the series of arraignments. One trial was set for Feb. 22 and the others were scheduled in March.
Bonds were set for all of the defendants except Randall Luther, 45, of Kermit, who is charged with first degree murder in connection with the death of Fred Brewer on June 16, 2009. Thornsbury denied bond for Luther, who was remanded to Southwestern Regional Jail to await trial March 8. Luther is represented by Williamson Attorney David Foley.
The court ascertained if all of the defendants appearing for arraignment had legal representation. Bonds set ranged from $25,000 to $500,000 with various conditions attached to the posting of bond in each case.
Thornsbury set $500,000 bond (full cash) in the case of a Wyoming County man, Herschel G. White, 69, of Brenton, W.Va., who stands indicted for one count each of first degree sexual abuse and sexual abuse by a custodian. Williamson Attor-ney Jonathan Jewell is his attorney.
Conditions of bond include such requirements as electronic home confinement; weekly random drug testing by the probation office; pill count on every visit; no association with any abuser of controlled substances; no contact with the victim, and benchmark drug testing.
