A Delbarton man is claiming police brutality after being arrested Oct. 14.

Micah A. Baisden, who was arrested on three counts of obstructing an officer, two counts of battery on an officer and battery, is now claiming that police used excessive force during his arrest.

The criminal complaint filed in Mingo County Magistrate Court by Investigating officers Deputy C.G. Endicott, Deputy Muncy and Deputy B.A. Moore, stated that Baisden allegedly struck Clinton Baisden Jr., his neighbor and cousin. The report explained (Micah) Baisden was having a verbal altercation with his father, Terry Baisden, when officers arrived on scene.

Officers allowed Micah to stay with Clinton, but he attempted to return to his father’s residence when officers left the scene. The neighbor tried to stop Micah when he struck. The defendant then tried once again to go to his Father’s residence when he was caught by police.

When police were escorting Micah to Delbarton City Hall for processing he struck Deputy B.A. Moore. Deputy C. G. Endicott then released his K-9 unit to apprehend the defendant.

However, Micah’s version of the events differs from officers. In an interview with the Williamson Daily News, he says Deputy Endicott’s K-9 Unit was released first and when he tried to fight the dog off officers struck him with a Mag-Lite flashlight. Micah stated that he was struck again with the flashlight at Delbarton City Hall. Micah also made claims that officers threatened to arrest Clinton if he didn’t file charges against his cousin.

Terry said he witnessed the events and felt his son was intoxicated and there was no need for the officer’s actions.

Clinton denies claims that he was threatened by police and said he didn’t witness the Officers actions to be brutality.

Mingo County Sheriff Lonnie Hannah denied comment regarding the claim.
