2 plea in Mingo Court

WILLIAMSON – A Mingo County man and a Martin County, Ky., woman received prison sentences in Mingo County Circuit Court Tuesday after entering guilty pleas and waiving pre-sentencing and probation investigations.

Chief Judge Michael Thornsbury imposed a sentence of one to five years in a state correctional facility after Tommy Junior Sincell, 34, of the Lick Creek area near Williamson, entered a plea of guilty to conspiracy to commit grand larceny.

Sincell, who was represented by Attorney Jerry Lyall, waived pre-sentencing investigation and probation. No fine was imposed but the defendant will be required to make restitution of $880 to Terry Pauley, the victim of grand larceny on Feb. 22, 2009. In return for the plea, the state will dismiss Count I of his September 2009 indictment.

Sincell allegedly conspired with another to feloniously steal a Honda 300 ATV owned by Pauley and valued at $1,560.

Assistant Mingo County Prosecutor Glen Rutledge represented the state in the proceedings for Sincell and for Tonya Noisha Perry, also known as Frye, 25, of Warfield, Ky.

Perry entered a plea of guilty to Count II of her September 2009 indictment, which charged her with uttering as true a Branch Banking and Trust Company check, knowing the same to be forged to the prejudice of Jerry Wellman and with intent to defraud Wellman on or about March 12, 2009. Another count charging forgery was dismissed by the state in return for Perry’s plea.

Thornsbury sentenced Perry to serve not less than one year nor more than 10 years on her plea to uttering. He also directed that the defendant make restitution of $1,300 to the victim of her offense. She was represented by Attorney Kathy C. Sturgell.
