Mingo bus driver’s drug charges dropped

A case against a Mingo County School bus driver and her husband and one other individual was dismissed on Thursday in Mingo County Magistrate Court.

Demetra Simpson, 45, Charles Simpson, 46, and Katrina Justice, all of Justice, were arrested on Monday, Sept. 21, 2009 by the West Virginia State Police for selling drugs.

The arrests were part of a two month long investigation by the Trooper at the West Virginia State Police Detachment, the complaints said.

According to Trooper Goldie, several buys were made at various residences in the Justice area.

The Simpsons were charged with three counts each of possession of OxyContin, marijuana and suboxone, two counts of delivery of a controlled substance and five counts of conspiracy. Justice was also charged with one count of delivery of OxyContin.

According to Chief Magistrate Eugene Crum, the case was dismissed because the investigating officer was out-of-town on another matter.

Crum explained that under West Virginia code they are entitled to a preliminary hearing within 20 days or charges have to be dismissed, however they can be directly indicted.
