The third Victory Lane robbery suspect, Cecil Ray Diamond, waived his rights to a preliminary hearing in Mingo County Magistrate Court on Thursday.

Diamond was arrested approximately a week after his alleged accomplices, Josh Daniel, of Daniel’s Branch and James Greg Robertson of Williamson.

Cecil Ray Diamond was arrested on charges of conspiracy, second degree robbery and grand larceny on Thursday, Aug. 10, 2009.

The criminal complaint stated that Diamond conspired along with Robertson and Daniel to rob the convenience store. According to the criminal complaint, Daniel entered the store with a chemical substance, called Cap-stun, and demanded money, while Robertson drove to a pre-determined destination and waited on Daniel.

Diamond is accused of supplying Daniel with the Cap-stun and clothes used in the robbery, and Daniel allegedly gave Diamond the money obtained from the robbery.

Sheriffs Cpl. Norman Mines, Deputy Cpl. Chris Endicott and Trooper B.R. Moore were the first to receive the call on Saturday, Aug. 29, to respond to the convenience store where the suspects allegedly took $1,400 and 10-15 packages of cigarettes.

Arresting officers Muncy Moore, along with the help of Deputy Sgt. Joe Smith, Deputy Sgt. James Muncy, Deputy Matt Lovern, Deputy Steven Smith, and WVSP Cpl. Harper and Trooper Kuhn worked to assist in solving the case by interviewing witnesses and suspects in the crime.

Josh Daniel, of Dan’s Branch, and James Greg Robertson of Williamson, waived their rights to a preliminary hearing and the case was bound over to the grand jury.

Diamond remains in the Southwestern Regional Jail at this time.
