KERMIT — Matthew D. Pennington, 27, of Belfry, Ky., was arrested on Monday on several charges by the Mingo County Sheriffs Depart-ment and the West Virginia State Police.
The criminal complaint stated police were dispatched to a motor vehicle accident at Jenny’s Creek, near Kermit. Mingo County 911 notified police that Pennington had left the scene of the accident.
The defendant was found at Johnson Hollow where officers noticed the smell of alcohol. Pennington then gave officers the wrong name and date of birth.
The officers returned to the scene of the accident and talked to Kermit Fire and Rescue Departmet and citizen witnesses who identified Pennington as the driver of the vehicle.
Witnesses explained to officers that Pennington had allegedly fled the scene of the accident.
His passenger, Robbie Taylor, had to be flown to Cabel Huntington Hospital.
Pennington was transported to Williamson Memorial Hospital before being ar-raigned for injuries received in the accident.
Police requested the defendant perform a blood alcohol test which he refused.
Pennington was charged with driving under the influence causing bodily injury, obstructing an officer, providing false information to officer and leaving the scene of an accident causing personal injury.
Pennington was arraigned by Mingo County Magistrate Pam Newsome and then transported to Southwestern Regional Jail, where he remained as of presstime.
