James D. Fairchild was traveling in a black Mustang on U.S. 52 in Kermit when he was stopped by Chief C.E. Chambers for no tail lights.
The officer asked for the defendant’s driver’s license, but he couldn’t speak because of a past surgery. Fairchild then wrote the alias James Hall along with an incorrect social security number on Chambers note pad.
Fairchild also gave incorrect information to assisting officer, Trooper D.J. Chap-man.
After further investigation officers discovered his correct name and social security number and had Mingo County 911 check the information.
Dispatchers notified po-lice that Fairchild’s license was suspected for driving under the influence.
Police also located 1-1/2 Loretabs at the defendants feet, in which he admitted the pills were his, but stated he was prescribed the medication.
After checking the licenses plate on the Mustang, dispatchers reported to police it was stolen from Vinton County, Ohio.
Fairchild was charged with six counts of obstructing an officer, third offense driving under the influence, possession, driving on a suspended license and receiving and transferring a stolen vehicle.
Police also arrested Fair-child on arson-burning or attempting to burn insured property and first degree arson on warrants obtained by the West Virginia State Fire Marshals Office and the Mingo County Sheriffs Department.
Fairchild was allegedly witnessed leaving the scene of a structure fire after a physical altercation with the occupants the night preceding the fire. The fire was determined to be arson.
Fairchild was arraigned by Mingo County Magistrate Pam Newsome where bond was set at $100,000. Fairchild remains in Southwestern Regional Jail.
