CHARLESTON (AP) — Two Mingo County residents facing the death penalty in the case of a murdered federal informant will be tried separately.

U.S. District Judge John Copenhaver Jr. granted motions by George Lecco and Valerie Friend to be tried separately. Lawyers for the two indicated in filings that Lecco and Friend plan to implicate each other in the 2005 murder of Carla Collins.

Friend’s trial is set to begin Oct. 27. A date for Lecco’s trial has not been set.

The two were convicted in 2007 for murdering Collins to protect their cocaine ring. Copenhaver recently ordered a new trial because of a juror’s misconduct.

West Virginia abolished capital punishment for state crimes. It remains an option in federal cases.
