Casey James Behelar II, 28, of Gilbert, waived his right to a preliminary trial yesterday before Mingo County Chief Magistrate Eugene Crum after being accused of participating in a home invasion July 12. Behelar asked for a continuance of the preliminary hearing due to not having legal counsel after he was denied a court appointed attorney due to an excess of income. Behelar is now represented by Attorney Steven New.
Behelar, in addition to the three other suspects in the case, Willie Wayne McCoy, 31, of Detroit Mich.; Chester Shirley Lester, 20, of Baisden; and Joshua Cantrell, 19, of Wharncliffe, waived their right to a preliminary hearing in July when Behelar’s case was continued.
Allegedly the four men allegedly kicked open the door at Bowles residence at Right Hand Fork in Baisden, and beat Bowles with a tire iron before taking $2,500 in currency and Oxycontin, according to WVSP.
While inside the residence, McCoy found a semi-automactic pistol and threatened Bowles and a 24-year-old female, whose name is not being released by police. McCoy then handed the gun to Cantrell who made Bowles lay on the ground, while McCoy took the female in another room and sexually assaulted her, said Sgt. Baylous, WVSP public information officer.
Reports from the state police also state Jimmy Keith West arrived at the residence during the incident and was also beaten with a tire iron. Police said that Lester and Behelar assisted as the look-out and driver.
The men were located at a residence at Big Lick Road on Baisden where police reported gathering some evidence from the incident.
All four of the suspects were charged with burglary, first degree robbery, kidnapping, grand larceny, first degree sexual assault, malicious wounding and conspiracy.
All four suspects remain in the Southwestern Regional Jail without bond.
