Ooten is accused of second-degree sexual assault and incest after his 54-year-old niece filed charges on Aug. 3, 2009.
The criminal complaint states that the defendant allegedly forced his niece to have sex with him after she told him to stop several times on July 21, 2009.
Ooten remains in Southwestern Regional Jail on a $100,000 bond.
Investigating officers on the case are Mingo County Sheriffs Deputy Sgt. Joe Smith and West Virginia State Police Trooper B. R. Moore.
The Daily News does not disclose the names of victims of sexual crimes.
