Dr. pleads to running stop sign State still investigating pill find

MINGO — All traffic charges against Dr. Brian McDevitt of Man, W.Va., were dropped in Mingo County after McDevitt pleaded Tuesday to running a stop sign and paid the $5 fee. However, the drugs found in his vehicle June 23 are still being investigated by the Bureau of Criminal Investigations (BCI).

“He never denied that he ran a stop sign,” stated McDevitt’s Lawyer Tim Koontz, following McDevitt’s plea before Mingo Magistrate Eugene Crum. “He is a good doctor and he will be returning back to his practice.

“The doctor was running late to see patients that day but that is no excuse for running the stop sign.”

Koontz also said that McDevitt had been completely exonerated of all charges however, the contents of McDevitt’s vehicle is still in question according to police officials.

The criminal complaint stated that on June 22 Investigating Officer B.R. Moore, performed a routine traffic stop on McDevitt after he ran a stop sign, almost striking a vehicle in front of him. McDevitt was released on a personal recognizance bond by Magistrate Dee Sidebottom.

The following day Moore obtained warrant to search the doctor’s vehicle, which had been towed to Duba’s Tow Company the night before.

During the search troopers and Mike Smith with BCI (Bureau of Criminal Investigations) recovered three trash bags of prescription pill bottles filled with phentermine, which is the generic form of Adipex-P, a schedule IV controlled substance. Officers also recovered $13,631 in U.S. currency and multiple checks.

Mike Smith said the contents of McDevitt’s vehicle are still pending investigation.

“Dr. McDevitt was in the process of taking schedule 4 medication to his weight loss clinic in Chapmanville,” said Koontz. “Nothing illegal happened and he has the appropriate records.

“He is a good physician and he will be exonerated of all charges.”
