Nine indictments, including five sealed, drug-related true bills, were returned Tuesday following a one-day session of the Grand Jury serving the April 2009 term of Mingo County Circuit Court.
Chief Judge Michael Thornsbury accepted the jury’s report and scheduled arraignments of defendants for 8:30 a.m. Thursday, June 18.
Two men identified as David Bryant, 23, of Oceana, W.Va., and Shawn Dempsey, 20, of Verdunville, W. Va., were separately indicted on 12 counts each.
Among the charges against them are grand larceny or theft of weapons, tools and other property and destruction of property belonging to Melvin Marcum; Phillip Marcum; Isom Ooten, doing business as Myrtle Chevron; the Dingess Car Wash and Larry Dillon, doing business as Dingess Car Wash.
Bryant and Dempsey are each charged with three counts of grand larceny, three counts of conspiracy to commit grand larceny, two counts of burglary, one count of entry of a building other than a dwelling, one count of conspiracy in the entry of a building other than a dwelling, and two counts of destroying property.
Bryant and Dempsey allegedly on March 4, 2008, feloniously carried away three guns, a television, three weed eaters, two chainsaws, a stereo and various tools valued at $1,000 or more, all property of Melvin Marcum. On that same date, the pair allegedly broke into Marcum’s dwelling house.
The two conspirators also are charged with feloniously carrying away personal property of Phillip Marcum that included three shotguns, a television, various lawn tools and hand tools with a value of $1,000 or more. Marcum’s dwelling house also was entered on that same date, March 4,2008.
The pair also is accused of feloniously stealing $800 in money and various tobacco products with a value of $1,000 or more from Isom Ooten, doing business as Myrtle Chevron. During that offense, personal property of Ooten including a glass door, an ATM machine, a wooden shelf, a West Virginia State Lottery machine and a security camera monitor were destroyed, causing a loss of $2,500 or more.
Bryant and Dempsey also are charged with breaking and entering the Larry Dillon property (Dingess Car Wash) on March 7, 2008, destroying personal property of Dillon that included an entry door and a cash machine with damage amounting to $2,500 or more.
Mingo County Sheriff’s Deputy B .R. Moore provided information on that case to the grand jury.
- Matthew Darryl Colegrove, 25, of Lenore, was indicted on one count of grand larceny of a 2003 Nissan Xterra owned by Myra Miller and valued at approximately $15,000. A second count charges him with conspiracy with an unidentified person in committing the grand larceny on July 31,2008. Information in this case was provided to the grand jury by Williamson Police Chief Roby Pope.
- Tony Hensley, 46, of Lenore, was indicted on a third offense of driving under the influence of alcohol, any controlled substance, any other drug or under the combined influence of alcohol and any controlled substance or any other drug. This offense occurred Jan. 20, 2008.
According to the indictment, Hensley was convicted of DUI in the District Court of Martin County, Ky., on Aug. 30, 1999, and was convicted of a second offense DUI in the Magistrate Court of Mingo County, W. Va., on June 14,2007. Mingo Sheriff’s Deputy, Sgt. Joe Smith, provided information to the grand jury in this case.
