CHARLESTON (AP) — A Massey Energy foreman has pleaded not guilty to five federal charges stemming from a fatal coal mine fire.
Court records show David R. Runyon entered his plea Tuesday and his trial was scheduled for April 20. Runyon is free on a $10,000 bond.
Runyon is accused of violating federal safety standards by skipping mandatory evacuation drills and falsifying drill records.
Runyon was foreman of a crew that escaped from a Jan. 19, 2006 conveyer belt fire at Massey’s Aracoma Alma No. 1 mine. Miners Don Bragg and Ellery Elvis Hatfield died after getting separated from another crew while trying to escape.
Attorney Nick Preservati has said his client has done nothing wrong.
Aracoma Coal already has pleaded guilty and agreed to a $2.5 million fine pending court approval.
