PIKEVILLE, Ky. – A variety of charges is contained in 27 indictments returned by the November 2008 Pike County Grand Jury with allegations of assaults upon family members, law enforcement officers and others dominating the list of offenses.

Commonwealth Attorney Rick L. Bartley, of the 35th Judicial Circuit, released the list of indictments, which included 25 regular true bills and two superseding indictments.

The list contains the usual indictments on drug charges, motor vehicle violations, burglary, theft by unlawful taking, robbery, receiving stolen property and charges of persistent felony offender.

– Jody Dotson, 26, of Steele, Ky., is named in three separate indicments, one of which charges him with the offense of assault, second degree, when he intentionally struck his uncle, Randall Dotson, with a dangerous instrument on Dec. 17, 2008, thereby causing a serious physical injury.

A second indictment charges Dotson with burglary, second degree, when he unlawfully entered or remained in Randall Dotson’s residence on Dec. 17 for the purpose of committing a crime. Another charge is theft by unlawful taking of a knife, rings, cartridges, credit cards and cash of the value of $300 or more, which belonged to his uncle.

A third indictment contains two counts of criminal possession of a forged instrument, second degree, on Sept. 6, 2008. He allegedly uttered or possessed two checks in the respective amounts of $502 and $526.07, with the name of Ronald Scott forged on each.

– James Justice, 32, Freeburn, Ky., is charged with assault, second degree, on Dec. 20, 2008, when he intentionally or wantonly struck James Justice, his father, with his hands and feet and/or a dangerous instrument, thereby causing a serious physical injury.

– Carl Pugh Jr., 45, of Pikeville, Ky., was indicted on one charge, assault, fourth degree, as the result of an incident on Feb. 19, 2008 when he intentionally or wantonly caused a physical injury to Debbie Goble, a family member, The indictment notes that he had two prior convictions for assault of family members in Pike County in 2005.

– A 26-year-old Elkhorn City woman, Veronica Holbrooks, was indicted on seven counts: Assault, fourth degree; Assault, third degree (three counts); Resisting arrest; Disorderly conduct, second degree, and public intoxication.

The charges stem from an incident on Jan. 29, 2009, when she intentionally caused a physical injury to Virginia Bowling, a family member; caused or attempted to cause physical injury to Kentucky State Police Troopers Kevin Thacker and Darrell Arnett and Sgt. Randy Woods, law enforcement officers (three Class D felonies); and committed three misdemeanors.

– Eric Wolford, 27, Freeburn, Ky., was indicted on a Class D felony of assault, third degree, on Jan. 3, 2009 when he allegedly caused or attempted to cause a physical injury to KSP Trooper Dallas Greer, a law enforcement officer.

– Gregory Fleming, 55, Lookout, Ky., stands indicted on one Class D felony (Assault, third degree), and five misdemeanors of different degrees.

On Jan. 18, 2008, it is charged, Fleming caused or attempted to cause a physical injury to KSP Trooper Kevin Thacker. He resisted arrest by a peace officer, and then committed terroristic threatening by threatening to commit a crime likely to result in death or serious physical injujry to KSP Trooper Jimmy Anderson, or likely to result in substantial property damage to said individual.

Fleming also operated a motor vehicle while under the influence of intoxicants, after having been convicted of such offense in Floyd County in 2007. Count V charges him with leaving the scene of an accident when he was involved in a wreck wherein a vehicle or other property was damaged. Another charge is operating a motor vehicle without a valid operator’s license.

– Two persons were indicted separately on charges of escape, second degree, from a detention facility or from the custody of law enforcement authorities. They are identified as Michael Wayne Farley, 30, of Lovely, Ky., and Tina Hager, 32, Lick Creek, Ky.

Farley allegedly escaped Jan. 9, 2009, and also committed the offense of theft by unlawful taking of cash in the value or $300 or less, which belonged to the Pike County Detention Center.

Hager is accused of escape, second degree, on Dec. 15, 2008, by aiding or assisting Hurley Dwayne Mullins to escape from a detention facility or from custody after being charged with or convicted of a felony.

– Darrell G. Smallwood, 53, and Michael Hickman, 43, both of Kimper, Ky., were separately indicted on a charge of failing to register relative to sexual offense during the period Jan. 10-15, 2009. Being convicted as sexual offenders, they failed to report their address or change or intended change of address as required in Kentucky Revised Statutes.

– Hubert Anderson III, 36, of Sidney, Ky., was indicted on charges of burglary, second degree, and theft by unlawful taking.

He allegedly unlawfully entered or remained in the residence of Jeff Settles on Jan. 7 or Jan. 9, 2009, for the purpose of committing a crime therein, and also is charged with receiving stolen property including jewelry valued at $300 or more, which had been stolen from Jeff Settles. He also is being charged with the offense of Persistent felony offender, first degree, having previously been convicted of seven offenses in Pike County during the period 1993 and 2007.

• Other indictments by the grand jury include the following:

– Buford J. Combs Jr., no age listed, Freeburn, Ky.; accused of criminal possession of a forged instrument, second degree, when, on May 7, 2007, he uttered or possessed a check in the amount of $4,000 to which the name of Oscar Combs had been forged.

– Gregg William Callas, also known as Greg William Callas, also known as John Stevens, 42, Prestonsburg, Ky., is charged with robbery, first degree; possession of a handgun by a convicted felon, and the offense of persistent felony offender, first degree for two or more previous felony offenses.

Callas, allegedly when in the course of committing a theft from Castle’s Jewelry on Feb. 4, 2009, used or threatened the immediate use of physical force and caused physical injury to a person not a participant in the crime, while armed with a deadly weapon.

– Two Phelps, Ky., men identified as Danny Dotson, 23, and Dorse Bentley, 32, are jointly indicted on a charge of robbery, first degree, when, in the course of committing a theft from Jo Mart, they used or threatened the use of physical force with the intent of accomplishing the theft, or while armed with a deadly weapon, theatened use of the instrument upon a person not a participant in the crime.

First offense of persistent felony offender, first degree, having previously been convicted second degree robbery in 2006.

– Donald Rex Williams, 54, Jenkins, Ky., was indicted on the offense of receiving stolen property in August, 2008, by retaining or disposing of metal form boards valued at $300 or more and which had been stolen from Wright’s Concrete and/or Kendal Wright.

– David Little, 20, Pikeville, and James N. McClanahan, 21, Dorton, Ky., were jointly indicted on charges of receiving stolen property and criminal mischief, third degree. They allegedly received or disposed of the contents of an automobile, valued at $300 and more, which had been stolen from Steve Sergeant. The two also are charged with criminal mischief, third degree, by damaging or destroying a window seal belonging to Sergeant.

– Kelly Crase, 29; Brittney Collins, 24, and Joni Miracle, 39, all of Whitesburg, Ky., are jointly charged with receiving stolen property (items valued at $300 or more and stolen from Walmart Nov. 25, 2008); and receiving stolen property (clothing valued at $300 or less and stolen from Underground Attitude).

Collins is additionally charged with promoting contraband, first degree, by introducing it into a detention facility.

Miracle is being charged with the offense of persistent felony offender, second degree, for having been previously convicted of a drug charge in Letcher County in 2005.

– Richard Bruce Huffman, 32; Tina Renee Huffman, 31, and Donald G. Mullins, 29, all of Pikeville, are named in the same indictment. The two Huffmans are each charged with trafficking in a Schedule II controlled substance, first degree. Mullins is similarly charged in two other counts of the indictment.All three defendants are named in Count V with trafficking in a controlled substance, first degree.

– Kevin D. Spears, 43, Louisville, Ky., has been indicted on charges of operating a motor vehicle while under the influence of intoxicants, second offense; possession of a controlled substance, first degree (second offense); possession of drug paraphernalia, and with being a persistent felony offender, second degree.

– Valarie Ratliff, 40, Pikeville, is charged with operating a motor vehicle on Jan. 7, 2009 while under the influence of intoxicants, after having been convicted of such offense in Pike County in 2005.

– Elizabeth James, 32, Pikeville, is charged with driving under the influence of alcohol on Oct. 20, 2008, after having been previously convicted on said offenses in 2004, 2005 and 2006. A second charge is that she operated a motor vehicle while license was DUI suspended or revoked due to three convictions in Letcher, Wolfe and Pike Counties in 2004, 2005 and 2006, respectively.

– Michael D. Gillispie Jr., 29, Pikeville, was indicted on three charges stemming from his arrest Feb. 2, 2009: Possession of a controlled substance, first degree; possession of marijuana, and operating a motor vehicle while under the influence of intoxicants.

– Larry Kendrick, 31, Rockhouse, Ky., is charged with offenses dating back to Dec. 4, 2008: possession of a controlled substance, first degree; possession of a controlled substance, third degree; possession of a controlled substance, second degree; possession of drug paraphernalia; tampering with physical evidence; resisting arrest, and a new charge of persistent felony offender, second offense for having been previously convicted in 2003 of second degree burglary.

The grand jury also issued notices of two superseding indictments that take precedence over two 2008 indictments.

– Jason Rose, 27, Pikeville, is the defendant in one of the indictments, being charged with promoting dangerous contraband, first degree (a cell phone) into a detention facility. He also is charged with the offense of persistent felony offender, first degree, as a result of two prior convictions for receiving stolen property and possession of a handgun by a convicted felon, in 2007.

– Jessica Reynolds, 26, Pikeville, is charged with trafficking in a controlled substance, first degree (Schedule I oxycodone), on April 10, 2008, and with being a persistent felony offender, first degree, because of prior convictions involving drugs.

(An indictment is merely an accusation and the defendant is presumed innocent until and unless proven guilty.)
