SIDNEY, Ky. — Two very different recollections of a bizarre situation that occurred on Wednesday, Jan 2, have basically one fact in common; that being that a student walked out of the Bevins Elementary School and was discovered on U.S. 119, a roadway that is traveled by a high volume of traffic. This fact, however, is where the similarities end.

The Daily News interviewed the elementary school Principal Amy Swiney in her office on Friday and also spoke with the Good Samaritan credited with getting the young child out of the median of U.S. 119 and onto the side of the road, who was identified as Keith Looney, the owner and operator of Looney’s Body Shop, located on Ky. Rt. 292. Following will be the accounts from both individuals and how they say the incident played out.

“I had been called out on a wreck on 119 and was headed back to my business when I saw something that scared me to death,” stated Looney. “I was in my rollback with a wrecked vehicle loaded when I approached the bridge on the 4 lane that’s near the entrance ramp if you’re coming from the Sidney area to get on 119 to go to Pikeville, when I was shocked to see a little girl that looked to be 7 or 8 years of age standing beside of the middle concrete barrier, on the northbound lane side. She wasn’t even visible from the southbound lane.”

“I couldn’t just slam on my brakes with the load I was hauling so I pulled over as quickly as I could and began backing up on the shoulder of the road, toward where the little girl was standing. I was shaking I was so scared…I was hoping and praying she didn’t step out into the traffic before I could get to her.”

Looney said that while he was backing up, he placed a call to Kentucky State Police (KSP) Post 9 in Pikeville (the time of the call was recorded at 9:14 a.m.) informing them of what was happening and asked that they dispatch a trooper or someone from the closest fire dept. to help him get the child to safety.

“I was traveling alone and I knew that the sight of this big truck with flashing lights and a wrecked vehicle on the back probably would scare her, and I was very worried she’d try to dart back across the other lane of traffic,” commented Looney. “When I got stopped across from where she was, I began talking to her, emphasizing for her to not move until I told it was clear and then to run across the road toward me. When there was a break in traffic, I motioned her on across and that’s when she froze up – right on the divided line of the 4 lane. I was terrified, my heart was beating out of my chest, but thankfully, I was able to get her safely to the grass beside of the road.”

“I asked her where she had come from and what she was doing in the middle of the road and she told me she had left school and was trying to get home…she said she just wanted to go home. She asked me to take her there and I told her we had to wait right where we were, that I had someone coming to help her.”

Looney said that shortly before KSP Trooper Hoyt Smith arrived on scene, three people who identified themselves as school staff members pulled up where he was standing with the child and one of them told her to get in the vehicle that they were taking her back to school, to which Looney said he replied, “No, she’s not going anywhere until a trooper gets here – I don’t know who you all are for one thing, and second of all, you’ve already had her in your care once today and she left, so we’re going to stand right here until the police show up.”

Looney stated that just a few minutes after this occurred, Trooper Smith arrived and spoke with him and the school staff members, who he said once again asked to take the child back to school, but said the officer placed the child in his cruiser and transported her there himself so he could have an opportunity to try to get to the bottom of what had taken place.

‘I’ve been in the body shop business and I’ve owned tow trucks for a lot of years,” stated Looney. “Not only that, but I’m also a volunteer fireman with both Belfry and Turkey Creek Fire Departments and I have personally witnessed the result of what a moving vehicle can do to a body. That was the terrifying thought that kept running through my mind as I was trying to get that child off of the 4-lane. I was absolutely scared to death.”

“What amazes me about the whole situation now that I’ve really started thinking about it was how many vehicles had passed this little girl without stopping to enquire where she was going or if she needed help, or at the very least, they should have called 911 and reported it. This child had to have walked approximately ¾ of a mile, maybe a little more, in order to have reached the spot where I saw her standing. She walked up the two-lane from the school, onto the entrance ramp for U.S. 119 and had crossed the northbound lane and was in the middle, next to the barrier. That would have taken someone her age and size at least 45 minutes to complete. It was cold – there had been black ice on the road and not only was the traffic a threat, someone with ill intentions could have grabbed her and this could have ended in a very different way.”

The account of how the incident played out from the school’s perspective was very different, and is written as they were told the Daily News by Principal Swiney.

According to Swiney, the incident occurred shortly after 9 a.m. The student was tardy that morning, and was dropped off at school by a family member and was only in her classroom for a short period of time when she apparently walked out while her teacher was assisting a group of children in another center (the classroom is divided up into 4 groups of students), and exited the school building via a door near the cafeteria which is not typically monitored by a staff member. The objective of the child, Swiney later said she learned, was to catch the family member that dropped her off at school because she wanted to go back home.

The youngster, according to Swiney, is said to have walked from school property, onto the roadway and when she was discovered, she was said to have been walking on the grassy area that runs parallel to U.S. 119, not in the road as the witness said. The principal said that a male driving in the southbound lane observed the child, pulled over and attempted to ask her where she was going and where she had come from, but the child refused to speak. She said he immediately went to the school and alerted them to the child’s whereabouts, while a search has already ensued within the building for the student after the teacher became aware of her absence.

“Within just a few moments of the child leaving the classroom, the teacher realized she was gone and sent other students to the cafeteria and to the restroom to see if she was there,” stated Swiney. “When she could not be located, she called the office to alert us and as we were talking to her, the gentlemen rang the buzzer at the front door of the school, saying a child was walking in the grass beside of U.S. 119.”

“She was only missing probably 15 minutes at the most before she was found,” said Swiney, which is a very different time frame than that provided by Looney.

The principal said three of her staff members that included the secretary, an instructional assistant and the custodian jumped in their vehicles and went directly to where the child was located and said that two other people had stopped to offer assistance and were there with the student. The secretary for Bevins, Sandy Harrison, told the Daily News that she put the 2nd grader in her vehicle and sat there with here until Trooper Hoyt Smith arrived on scene and transferred the child into his police cruiser. The staff members followed the trooper back to the school and stated that Smith spoke with the child for a period of time, explaining to her why what she did was so wrong and how dangerous it was, and told her that nothing like this could ever happen again, to which the child is said to have agreed. The parents were then contacted.

“We have received an award in the past for being declared one of the safest schools in the state of Kentucky,” remarked Swiney. “We have had KSP Trooper Jim Nolte come several times and speak with our students about different scenarios that they need to be prepared for, and following the school shooting in Connecticut, we asked him to come back and do a walk through with us to help us identify areas that needed extra attention. After Trooper Smith left on Wednesday, Trooper Nolte came and spent a couple of hours here, speaking with all of our students about the dangers of leaving the building without permission. We’re grateful to him for all of his assistance.”

Swiney pointed out the surveillance camera located at the front entrance of the school and to the fact that no one can enter the building without permission, and said she is currently looking into expanding the cameras to include the other exterior doors to prevent anything like this from happening in the future. She has also placed what she described as large jingle bells on the classroom doors of the head start through 2nd grade classes, which will alert the teachers of anyone entering or exiting. Swiney further stated that the teachers would be locking the doors from the inside to cut the chances of a student exiting undetected.

“We are going the extra mile to protect our students. First and foremost, I want to emphasize that we immediately sprang into action the moment we realized the student was missing from the classroom. Learning from this, we will take every measure possible to assure this never happens again. We have precautions and plans in place to ensure the safety and welfare of all of our students.”

“I’ve been the secretary here for over 20 years and I can tell you with all honesty, nothing like this has ever happened before,” stated Harrison. “The parents that have children attending here know that their kids are our top concern. They always were – and they always will be.”

Swiney repeatedly told the Daily News that the child was never in the middle of the 4-lane, but Looney was adamant about where the child was when he first observed her on the roadway. Trooper Smith was not on duty on Friday, nor could Trooper Nolte be reached or the KSP Public Relations Officer, Trooper Shaun Little so their statements were not available. An interview with those who investigated this case will occur within the next few days and will be published for the public as soon as the information is obtained.

Pike County Superintendent Roger Wagner was contacted but did not wish to comment on the incident, and asked that we speak with the Bevins Principal since she had a first-hand account of what had occurred. He did say, however, that the safety of students was the top priority of all Board of Education staff members.

I have read many,many of the Comments. After doing so many have good points about the situation.Some comments I just don't understand why protecting & defending the Faculty is more important than that child's safety.I myself want to Thank Mr. Looney for thinking & taking time out for insuring this child's safety.

This child may not of made the right decision on what she did,& I am sure she will learn from this. But we all should be Thankful that a good citizen came along to help her in this situation.

I would like all to stop & think what if this was a child abuser, a child molester, a drunk driver. This all would of played out differently in what people said. Can't we all just be Thankful this child is Safe regardless who should be at fault here? The safety of a Child is more important.

You know. It does not matter any more what any one thinks or says. This is the end of this. Nothing is getting done to any one. It is over and dropped like it never happened. I think that a couple should have been suspended but nothing is getting done so it is wasting our time writing and this is the last I am going to write or read on this.

I believe Mr. Looney told it like it was.I believe the Principal is trying to cover her back with thinking less time is okay.Regardless the child was able to leave the school. Also a lie has been told when it was spoken it never happen in 20 years.18 years ago My nephew also walked out the doors of the school and walked all the way home across the road up alongside the old route of hwy. 119 to his parents home. and exactly 1 week later my daughter in kindergarten at the time also did the same thing. After that happening with my daughter I removed her from that school and began Home schooling her so I knew she was protected & safe.It just urks me for a person to deny things have ever happen in their care before, when the truth hurts no one, well maybe the loss of the job and big fat check they get but tell the truth. I am sure it's happen many times since my daughter did it.

Wagner from the BOA resigned. It is on front page today. Wonder if this is the real reason he resigned. It stated he resigned over low scores. Things that make you go hummmm.

In reply to pike_mother. Are you even serious? Public schools are free? Excuse me we pay school taxes so no it is not free. The one's paying school tax is paying YOURS and everyone else that work's in the school system's salary. Just because someone home school's does not mean that their children do not interact with other children. The teacher is to blame on this she let a child wonder off point blank. You talk about parent's responsiblity where was the responsiblity of the teacher? Also where was the commen sense of the teacher when she sent ANOTHER CHILD out to look for the first one gone missing? This is in reply to this post..............

My child is 8 months old, so no she doesn't get around too fast lol.. I'm saying a 2nd grader knows better and should be punished! When I went to school I would've dared to leave school because I know the punishment that would've happened (at home and school). Children must be held accountable for their mistakes or they'll never learn right from wrong, wether it's leaving school, getting in a fight, or saying a bad word.

I work in schools and I see it everyday. Kids that their parents want to cover up for them and blame someone else for their own lazy parenting resulting bad kid. Like "my kid got bad grades??" It must be the teacher's fault! Couldn't be because my kid didn't study or doesn't care. These kids grow up to be drug addicts and losers because mommy always took care of all problems, so they never learn true independence and accountability.

Public schools are free and you get what you pay for. Want one-on-one attention? You have to homeschool your child. Then deal with the resulting lack of social skills. Eventually, they'll have to join the real world and I hope you won't still be smothering and overprotecting them..

Yes a child in 2nd grade should understand its not acceptable & tat they can not just get up & leave. But some 2nd graders comprehension is behind most 2nd graders of knowing they can't do it.All in All it is the teachers and Faculties responsibility to control a student and watch them keeping them safe from doing this. A 2nd graders mind isn't mature as the adults that the parents put trust in to keep their child safe. When a Officer came & spoke of things has anybody thought that some of the children didn't understand what was being explained to them? Why accuse & attack a Parent for a child not learning. Many children get help from Parents & still get bad grades.Also in Kentucky many Parents can not read & write their self to help a child.Should parents that help the child be verbally attacking a teacher because the child got a bad grade as you are attacking a Parent cause a child has a bad mark or does not learn fast enough or even understands as fast as other children?2nd grade is a lot more difficult now in learning compared to when many of Us was in 2nd grade 30-40-even 50 years ago. Children have learning disabilities that no one seems to approach & want to help until the last few months of school.All in All you are acting very immature. Making statements against parents which is uncalled for. Remember your child will also attend school someday and make bad grades.So at that when it happens should others state the same thing about you why your child gets that bad grade? So to attack & make such ridiculous comments discriminating & categorizing is way out of line. I home school all my children & they graduated with honors when tested & went on to attend some of the finest colleges in United States.3 of my children are in Medical field with their own businesses. And 2 of my children are now very Fine Lawyers. You are way out of Line to attack Home schooling a Child.I think you owe many parents an apology for attacking them with your comments.The Kentucky School system offers one on one to many children that needs extra help. Last opinion of the day.Your Last paragraph really shows how much of a selfish person you are. Also where do you get school is free. Because School is not Free. Tax Payers many who do not have school age children help pay for the schooling many children get. Many Parents pay out of pocket expenses because the family income exceeds. School is not Free.Exactly how would a 2nd grader be punished? I myself think Punishment should lay on the Faculty who took their eyes off this child & allowed her to walk away from school Property.

my child goes to a great school which its a independent school,and its a great school,they do have teachers aid,in all classrooms,which i think they should be in all the schools,as well as the rooms,and if a child goes to get a drink of water,u better believe theres a aid there with them,i dont blame no child in this matter;as no child should be the blame.as i do say alot they could of been something that this little angle was going through and noone knew about it,maybe her parents or parent did ask maybe she wouldnt talk about it,it could have been school or home;but to say she was skipping school i dont think that is a subject in this matter as i know alot of u will say the same.as a watch on this child yes..they should have been someone with her,im a firm believer in that for a fact!also for those who are afraid to send their children to school when it is time for them to go,dont judge all schools, like the old saying goes dont judge a book by its cover,oh how true is that,theres nothing wrong with sending your children to school,to interact with other children,some may be afraid that oh no my child wont be protected,yes they will or omg,look how many wrecks that a bus has or how they mix big kids with the smaller kids,you really need to try it,to get the fear away,as you never know they may love it,my children could go to county but i chose to pay for my children to go where they go yes i take them,but they also love to ride the bus as they go on trips and so on,so all you ferafull moms try it,and if you cant,as we all understand,im talking from being a parent and a teacher..but as this child to skip school is not a subject,thats a shame and were on not on here to bash eachother,and they are also a couple of great homeschool programs,i will put some links on here as i did before but they got deleted..as alot of comments did....

this clearly shouldnt been no accident,but as i understand as u all do.when my child goes to school,that means my children are in the schools care,so they shouldnt be any mistakes @ all,so the teacher yes,i have to say i do blame her,or the school for not having her an aid.to be with the children,at anytime they were out of the classroom....NOT the childs fault in no way or form....now everyone has their own thought about it,and this is mine,as i read all of yours,thanks

I am glad that the WDN deleted the comment where someone was accused of doing drugs. That should have never been put on here. Good call on that one WDN. I did not believe that comment. I am also glad that the lady printed that comment off so if the person accused can get them for slander. Unless it is the facts then it does not need on here. I would ban the IP of the one trying to start trouble. This is not for bashing and arguing it is to try to get the children in our school system safe. I hope this gets worked out for what is best for the children and their safety. Keep this clean and respectful and stop trying to make problems. Be adults.

to:lovethenews....i so agree with you,things as a drug use of anyone should not be used to the public,unless they need to do so,in this case,thaat should have not been the matter..this is not a bashing or arguing subject,i know and saw of them who are doing so,and the subject is to keep our kids safe,i so agree with you on keeping this matter of subject respectful and clean,and all be adults about all of this,its not going to solve nothing to get on here and bash one another..im just glad as i hope and pray the others are as well that she is safe,and teachers and parents need to be more alert on whats going on with the children as parents or teachers,cause when anyones child is at school its in their hands to protect my children as it is anyones children..

To;lovethenews on;I know the lady that asked if the child was in special ed and she did not ask that to be mean she asked that because if the child has something wrong with her then she should have been watched more closely. The girls skips school and its everybody elses fault? A 7 year old KNOWS that they aren't supposed to leave school grounds. She should be suspended, end of story. Those of you who are leaving the negative remarks, from the spelling/grammar of your comments it doesn't look to me like you spent much time in school. Why the sudden interest? Axe to grind?

NO SCHOOL can prevent this from happening. By law, the doors cannot be locked from the inside, and if children weren't allowed to take bathroom breaks unattended you'd be the same parents calling the BOE to whine and cry. I have a child in the 2nd grade and he knows what will happen to him if he leaves the school building, even if just for a minute.

And event though Mrs. Dove tried to make someone out to be a liar in this article, I really don't believe either side to be liars. But in all instances two parties will have different versions of the truth. From a journalistic point of view I place all the blame, solely and entirely,on the WDN...even though the article was written by one journalist with middle school writing skills.

[protect a young child] And never contacted the parents or police in an attempt to keep it quiet.And my child don't know any better when a child wants mommy & daddy they will try to find them. Blaming WDN wow. Grow up. A child left school. The police and parents should have been called. By the grace of God and Mr. Looney the child was safe. How does anyone know where the child was found unless they was there? The one man that found her and went back to the school how did he know where she ended up at? He only knows the last place he saw her and he did the right thing he went back to the school if he had a cell phone he should have called 911. He may not have had a cell phone. Mrs. Dove from the WDN only wrote what she was told. She did a terrific job. There needs to be quiestoning starting with the teacher and then go from there. I am sure the parents will do what needs to be done legally as they should. This does not need to be let go or set aside. I find it funny how everyone at the school knew where she ended up when they was not there. How can they say Mr. Looney lied he was there. It takes time to stop and back up and then call 911 and get the child to safety no way that was done in 15 minutes or less. 911 plainly said his call come in at 9.14 if you read the article. I am sure the judge will get all facts not hear say but facts and take it from there. As one has stated we are not God and we can not judge no ones religion. That is just wrong. I am glad the child is safe.

To AbovePointingFingers, really??? Look at your own "Paragraph 3" before you start throwing stones. Secondly, get your facts straight. The reporter's name is not "Mrs. Dove". Recheck that fact. And, were you there when she was interviewing? If so, then that answers that question. If not, then how do you know what the witnesses told her? Mrs. BALDWIN does an exceptional job reporting stories and all of them are very well written. Mrs. BALDWIN investigates and reports what she's told. This isn't a personal issue for her. Why are you so upset with the reporter? Shouldn't you be more upset as to why this child ended up in a dangerous situation? GROW UP!

OMG...really your gonna go with that ,the girls skiped school,shes 7years old,come on.and yea the blame should be on the teacher,also should have never sent another kid after her,knowing the lenght of time she was gone,and maybe your right your child might not,but you never know,noone knew what was on that kids mind when she left,even tho,we shouldnt be at eachothers throats on here,we are adults we should talk like them,as parents,teachers and MOTHERS..its a really scare when something like this is going on,this is to all moms out there talk to your kids when they get home see if anything is bothering them,cause in fact you never know,most of all thank god she was safe and nothing happened to her..and for all comments that got deleted,they should have stayed where they were,thanks:)

First off you need to know the child's state of mind. Was the child in a regular room or was she specail ed and did not know any better to walk off. Don't blame the child till you find out her story. You talk about judging others you are judging the child with out knowing her circumstances. Shame on you.

to:ryantrout...im not on here to judge noone as noone can judge anyone but the man above,im just glad that the kid is safe,but i dont think that the child should be no blame cause anything could have been wrong,as i tell all parents to talk to ur kids daily,when they come home from school to see if anything is wrong as we never know ,its a cruel world as we send our little ones out in it!but i do think the parents should have been called as the police. thank god for Mr.looney.

For one thing, Mrs. Swiney is not to blame here and Mr. Looney done the right thing by getting the child to safety. If anyone is to blame it should be the teacher that had her in her classroom and not having enough cameras in building, in which the school is in process of getting done soon. But whatever the time lapse was, lets just thank the good Lord the child is safe instead of calling Mrs. Swiney a liar and Mr. Looney a liar. There is always two sides to every story. So you people that want to try and start trouble and run your mouth on something you know nothing about except from what you have read and from what you have heard need to thank God that the child is safe instead of being trouble makers. And for Mr. Wagner not having anything to say on the situation, is because, I would say he is getting heat from it and it looks bad on the school and the school board, so he has nothing to say on the matter just yet. But Amy Swiney would never lie to save her job over the life and safety of a child. If you knew her you would know she is good Christian woman, wonderful mother, and very caring and loving person. And Mr. Looney is a good caring guy that saved a little girl from getting killed, hurt or abuducted and he should be thanked and to be considered a hero for what he done. So you all need to get your facts straight before you start calling people liars and be thankful that the child was unharmed.

I am a parent of a child at this school and we are so lucky to have such a wonderful staff and principal. Everyone there cares about the children, their education and most importantly their safety. Every parent can go to the precautionary steps to become a volunteer, yet in the time of needing someone to volunteer their is only a select few who are really there to help. This is an unfortunate accident in which we can make preparations so this never happens again. I'm sure all parents at the school, the teachers, and the principal, are concerned about this incident and glad the child is safe, however this is not the time to speak down about the school, employees, or the principal. We need to stand united and support the wonderful caretakers of our children, And thank The Lord Jesus above for protecting this child.

Sorry, I am from another state, but as a teacher if a student is unaccounted for for over one minute we have to mount a search, notify police and parents and turn ourselves into Department of Children and Families for a neglect investigation. We have drills and have still had a child wander (into the darkened cafeteria), had ourselves investigated. It is absolutely unthinkable not to call in EVERY resource to secure a child's safety

I am sorry i do live in this community and i really wouldnt send my kids to bevins it is unsafe i mean who has a school that is so close to the road and it scares me that it took 15 minutes for a teacher to realize that the kid was missing and i kno looneys body shop and i kno that this guy would not lie it seems to me like the people who where involved in trying to get the little girl could hav done a better job and how in the world did all 3 staff people show up at the same time a little funny dont u say...and plus i think the parents should hav been notified as soon as they realized the little girl was gone that was a stupid mistake i kno one thing if my kid was off the school premises i would want to be the first to kno and yes i say it those parents are blessed that kevin seen the little girl cause if he hadnt its hard to tell what would hav happened to her cause it seems like the staff didnt....all schools should be better monitored i think and more alert....some of them are and some of them aint...

Well as the wife of Keith Looney all I Have to ..exactly the way it happened period he has no reason to lie as r MRS SWINEY we do not no her but why she said that it happened the way it did shes wrong very wrong ..She just made her problem alot worse by saying that what really happened didnt . And when the truth would have made it much better r her. AND R ALL U PPL THAT R CALLING KEITH A LIAR U WASNT THERE U R ONLY MAKING YOUR SELF LOOK STUPID HE HELPED A CHILD THE WAS IN A LIFE ORDEATH PLACE .
