Guilty pleas entered in Mingo Circuit Court

WILLIAMSON – The following guilty pleas were entered in Mingo County Circuit Court, with the Honorable Judge Michael Thornsbury presiding.

The first case to be heard was the State of WV vs. James Bryant; Bryant pleaded guilty to conspiracy (grand larceny) as charged in Information S12-F108. Bryant waived the right to a presentence investigation and was sentenced to confinement in a state correctional facility for an indefinite term of not less than 1 year nor more than 5 years. Bryant received credit for 252 days served at Southwestern Regional Jail. The defendant was represented by Attorney Ronald J. Rumora. Mingo County Sheriff’s Department (MCSD) Sgt. J. Smith was the investigating officer.

In the State of WV vs. Donald Caudill; Caudill pleaded guilty to false statement (welfare fraud) as charged in Indictment S12-F74. Caudill is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than 1 year nor more than 5 years. Caudill was represented by Attorney Jerry M. Lyall. West Virginia Department of Health and Human Resources (WVDHHR) Investigator Ellis Bryson was the investigating officer.

State of WV vs. Samantha Lynn Marcum; Marcum pleaded guilty to child neglect creating risk of injury as charged in Indictment S12-F86. Marcum is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than 1 year nor more than 5 years. The defendant was represented by Attorney Susan J. Van Zant. WVSP Trooper D. L. Contos was the investigating officer.

In the case of the State of WV vs. Anthony Dow Sammons; Sammons pleaded guilty to assault during commission of felony and grand larceny as charged in Information S12-F109. Sammons is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than 2 years nor more than 10 years for the assault during commission of felony conviction and an indefinite term of not less than 1 year nor more than 10 years for the Grand Larceny conviction. Sammons was represented by Attorney Jonathan “Duke” Jewell. MCSD Sgt. J. Smith was the investigating officer.

The State of WV vs. Amy Renee Williams; Williams pleaded guilty to attempt (fraudulent scheme), a lesser included offense of fraudulent scheme, as charged in Indictment S12-F103. Williams is exposed to a sentence of confinement in a state correctional facility for an indefinite term of not less than 1 year nor more than 3 years. Williams was represented by Attorney Joshua S. Ferrell. MCSD Sgt. J. Smith was the investigating officer.

Caudill, Marcum, Sammons and Williams will be sentenced on Dec. 3 at 9:00 a.m.

The State of WV was represented by Prosecuting Attorney C. Michael Sparks, and Asst. Prosecuting Attorneys Teresa D. Maynard and Justin J. Marcum.

The Mingo County Prosecuting Attorney’s Office has achieved 78 felony case convictions in 2012.
