BREEDEN — An accident that occurred on Nov. 7, between a private vehicle and a Mingo County school bus at Breeden that left one dead has now resulted in the arrest of the driver on charges of DUI causing death and reckless driving.
A warrant was obtained by Mingo County Sheriff’s Deputy M.J. Mounts against Lewis Wendall Perry, 40, of Wilsondale, who was the driver of a vehicle in which the passenger, Randolph Marcum, lost his life.
On Nov. 7, Perry allegedly crossed the center line of the roadway and struck a school bus that was empty, except for the driver. Marcum sustained severe injuries during the collision and was pronounced dead on the scene by Mingo County Medical Examiner Mike Casey after being extracted from the vehicle by members of the East Fork of Twelve Pole Volunteer Fire Department.
The criminal complaint further states that alcoholic beverage containers and prescription pill bottles were found at the scene. Toxicology testing performed on Perry while he was a patient in the Cabell Huntington Hospital, where he was transported following the accident, produced positive results for marijuana and Xanax, which is a benzodiazepine.
Perry was arraigned on the felony charges before Mingo County Chief Magistrate Dallas Toler and was remanded to the Southwestern Regional Jail at Holden on a $52,500 full-cash bond.
