Mother arrested for DUI, child neglect following accident

DAY STAR ROAD - A young mother who was driving with her 11-month-old twin girls in a vehicle was arrested and charged with DUI, second offense; driving on a revoked license; leaving the scene of an accident; child neglect and no proof of insurance following an accident that occurred on Day Star Road, off of U.S. 119.

The criminal complaint filed by West Virginia State Police Troopers D.L. Contos and J.D. Matheny stated that they responded to a 911 call reporting a single vehicle crash at the location and observed a Chevrolet Cavalier sitting in the roadway that was said to have been on its side in a ditch before passerby’s hooked a chain to it and placed it back on its wheels.

The officers spoke with two men standing near the car, who told the officers that the female driver was at a nearby residence. The males were instructed to tell the driver, Samantha Lynn Marcum, 22, of Kermit, to return to the accident scene.

Trooper Contos stated that, while questioning Marcum, she was noted to have glassy eyes and was having difficulty maintaining her balance. The officer then performed the three standardized field sobriety tests on Marcum, which she failed to complete. A case worker with the West Virginia Department of Health and Human Resources Child Protective Services was called to take custody of the twin infants who were uninjured during the accident.

The mother was then transported to the Williamson Memorial Hospital where she consented to a drug urinalysis test which produced positive results and showed high levels of Barbiturates, Benzodiazepines, Cannabinoids and Opiates in her system.

A records check was done through the Department of Motor Vehicles and Marcum’s license was found to be revoked for a prior DUI that occurred on 12-01-2010 in Wayne County.

Marcum was arraigned before Mingo County Special Magistrate Joey Kohari and was issued a bond of $9,000. She was incarcerated in the Southwestern Regional Jail at Holden and was released from custody after posting bail.
