WILLIAMSON - A Chattaroy resident was placed under arrest on charges of two counts of petit larceny and obtaining money under false pretenses. The arrest stemmed from two separate criminal incidents.


Marcus Frias, age 32, was taken into custody by West Virginia State Trooper J.R. Tupper, after the officer investigated the theft of a Samsung Galaxy Tablet valued at $400 that belonged to Staff Sergeant Donna Smith from her place of employment, the United States National Guard Armory, located in Williamson. The defendant also allegedly stole$200 in cash from Sgt. Smith’s vehicle while she was providing transporting for him at no cost.


Upon making the arrest, the trooper discovered that a second warrant dated Sept. 6th had been filed on the defendant by Mingo County Sheriff’s Department Cpl. C.G. Endicott, for obtaining money under false pretenses.


The criminal complaint states that victims Jared and Kristy Hatfield hired the defendant to lay block underneath a double-wide mobile home. The defendant requested half of the pay up front before he started the job, and was suppose to return the next day to begin but did not show up. The victims went to their financial institute to stop payment on the check but discovered that Frias had already cashed it.


The Hatfield’s made contact with the defendant and he assured them he would be there on another date but failed again to keep his promise. The victims voiced their complaint to Frias and told him that if he did not do the job or return the money, there were filing a police report, to which he allegedly replied, “Go ahead, there’s nothing you can do about it.”


The defendant was arraigned on the two separate charges before Mingo County Chief Magistrate Dallas Toler and Magistrate Pam Newsome, and was remanded to jail on a $1,500 bond. Frias is scheduled to appear this week in court for a preliminary hearing.
