DELBARTON - West Virginia State Police Trooper D.C. Moore recently obtained warrants against a Mingo County man on felony charges of third-degree sexual assault, as well as soliciting a minor.
According to the criminal complaint filed in Mingo County Magistrate Court, Jeremy Lowe, 22, of Helena Manor at Delbarton, reportedly committed the crime in April with a 15-year-old female. The report states that Lowe performed a sexual act with the 15-year-old juvenile while at the Helena Manor Apartments and at different locations around Delbarton.
Lowe allegedly began a sexual relationship with the victim in mid-April, by kissing and having sexually explicit conversations with her via Facebook and Skype. The conversations allegedly included the defendant talking about having the female kiss him, as well as performing sex acts with him. The trooper states in the complaint that Lowe was fully aware of the female’s age at the time of the encounters.
According to the statute dealing with the crime charged, a person is guilty of sexual assault in the third degree if they engage in sexual intercourse or sexual intrusion with another person who is mentally defective, mentally incapacitated or who is less than 16 years of age, and if the victim is more than four years younger than the defendant.
The statute regarding the soliciting of a minor reads that any person over the age of 18 who knowingly uses a computer to solicit, entice, seduce or lure, a minor known or believed to be at least four years younger than the person using the computer, or a person he or she knows to be a minor at the time the crime occurs, shall be guilty of the offense.
Lowe was arrested May 21 on the warrants obtained by Moore and Senior Trooper J.J. Dean III, and was arraigned in court by Senior Status Judge Kim Blair. The defendant was remanded to the custody of the Southwestern Regional Jail at Holden in lieu of a $50,000 cash bond. Lowe is scheduled back in court this week for a preliminary hearing on the charges.
